COMPLICATION IN COURT

ACTION.

The case in which Mr. J. H. Ruttonjeo of Messrs. Ruttonfed and Son, wine merchants, la suing Mrs. D. A. Ross, formerly living at No. 7, Duddell Street, second floor, for $173.20 on an implied contract for the supply of electric was again before the acting Puisne Judge, Mr. P. Jacks In the Summary Court yesterday afternoon.

current

11

At the last hearing the case was udjourned for a witness from the Electric Company to be called to give evidence with regard to the moters in the fats. Mr. J. T. Prior is for the plaintiff and the defence is being conducted by Mr. W. D. Owen.

41

Yesterday afternoon Mr. S. Longfield, of the Hongkong Elec- tric Company, said that the present moter No. 26219 was registering current for No. 8 flat, (which was occupied by the defendant) when he visited the premises on June 27th. He therefore assumed that the meter had been connected to the flat ever since it was fixed in 1925, as there had since been no alterations to his knowledge.

Witness went on to explain. that meter No. 24040 was originally fixed for the whole of the second floor in May 1925 and at that time there were 31 lights and nine soc. kets connected with it.

The meter remained there until October 1, 1926, when it was disconnected. On October last year Mr., Ruttonjee applied for the meter (24040) to be re-fixed for the second floor for three lights only, but the number of the flat it was to serve was not mentioned.
