The cases had been adjourned from last Friday and he appeared to-day on that adjournment. If the cases had. been withdrawn, he would ask for costa on each of the eases.

Mr. Russ remarked that he could say nothing. Had his client been willing to do so, he would have fought the cusés.

Is Lordship remarked that he thought Mr. Sirellett was entitled to costs up to date.

Mr. Russ replied that he was certainly entitled to costs.

His Lordship accordingly made an order for costs in favour of Mr. Strellett...

Last Friday, Mr. Strellett con- Lended that, the five writs really represented one claim of over $3,000, but they had been split into amuller amounts in order to bring them within' the jurisdiction of the Court. He said the Ordinance provided that that practice should not be followed, and that the ac tion, should have been brought for the one total amount in Original Jurisdiction. Mr. Russ contended that the claims represented five. different transactions, and five different promissory notes.
