JUDGMENT ENTERED FOR PLAINTIFFS.

Judgment was given by Mr. J.H. B. Nihill in the Summary Court yesterday in the case in which the Texas, Company sued Mr. A. J. Lane, an architect, far the value of goods supplied.

The case concerned the water- proofing of a roof with Texacont," payment being disputed on the ground that after two coats of the preparation the roof still lenked.

A guarantee could not be read into a contract of this kind. It must be in express

In the absence, therefore, of a guarantee the defendant must pay for the work done. The plaintiffs were still under the obligation of paration without charge, and the applying a third coat of the pre- defendant could request them to do so if he wished,

Mr. Nihill added that the water- proof qualities of the plaintiff's preparation were not an issue in the case nor were the bona-fides of the defendant questioned;
