The case in which a Chinese is charged with fraud to the extent of $9,000, which was alleged to have been overpaid to him by the Bank of Canton, was again con- tinued yesterday morning, before Mr. R. E. Lindsell.

Defendant's Story.
The defendant, Li Yu-wan, thon went into the witnesa box. He was warned not to say anything that would incriminate himself. He atated that he was Manager of the Wah Fung Bank, of 99 Wing Lok Street, and had an account in the Bank of Canton under the name of Kwan Un. On the 18th December | he 'presented a cheque for $1,000 at the Bank of Canton drown against that account. He was told to wait, hut did not do 80, pre- ferring to go away and return a little Inter for hia cash. He re- turned at a little after 12 noon and asked a clerk in the Bank named.] Ng Chiu-hang if his money was ready and was told that it was. The clerk questioned him as to how much he was to receive and he replied "$1,000." It was the usual practice of that Bank to ask how much a person expected against his cheque before they would pay over the cash. He was quite sure that on that particular occasion the clerk had asked him what he ex- pected to receive. He was handed two notes of $500 each which he took back to his shop and locked up. in a safe.
Drawer Ransacked,
in his evidence, Mr. W. A. But terfield stated that on, the morning of the 10th inst when he returned to his office he found that the right side of his desk had been cut as if by a chisel and that the drawer which contained his cheque book and other personal articles had been prised' open. He noticed that his pistol was missing although the holster was still there. He also missed his cheque books. He im- mediately notified the Hongkong and Shanghai Bank of the loss, He then rang up the police and on the arrival of Detective Sergeant Baker witness advised him to look for a
man named. Dick Chan. After the police had gone ha dis- covered his cheque book when sort- ing through the debris. Just after he found the cheque book the Bank rang him up to tell him that a man had presented a cheque in his name for $500 to the order of "Mr. Brown." He went to the Bank where he examined the cheque and A man found it to ba,a forgery, from the Bank then took him to where a number of Chinese were standing and there he saw Chan, the man whom he dismissed a few days before. Besides othér things witness missed three notes of 10 pesos each. Witness also denied having given the defendant the reference which was produced in court. A key which was found in the possession of the defendant when arrested was identified by the witness as the key to the Car-- penter's workshop on the 7th floor of the A.P.C. Buliding.
