FURTHER EVIDENCE IN HOMUNTIN CASE,
The acting Pulsne Judge (Mr.
J. H.. B. Nihill) yesterday aftor- noon continued the hearing in the Summary Court of the case in which the texas Company of Queen's Buildings, sued Mr. A. J.
Lane, civil engineer and architect, for $145.50 for work' dono and. materials supplied to a house at | No. 4 Liberty Avenue, Homuntin.
Mr. H. J. Armstrong (Messrs Deacons) appeared for the plain- tiffs and Mr. F. G. Vaux (Mossre Wilkinson and Grist) for the de- fendant.
At Monday's hearing, evidence

was given to the effect that the. plaintiffs. contracted to lay 0 number of Canton tilos along part of the parapet of the roof of tho house, which was in disrepair, and to apply two coats of a pre- paration known as "Taxacoat" ta the roof. It was contended that this had been done and the work, carried out in a proper and work- manlike manner.
The Puiene Judge observed at- the outset of the hearing yester- day afternoon," that the terms of the contract were not confined to the application of two coats of Texaccat, but a certain amount of rooting as well in order that "a satisfactory job" might be made..
A "Watertight" Warranty.
Mr. Armatrong said the whole question was whether the para- Kraph In the plaintiffs' letter in which they stated they would make a thoroughly satisfactory job, was a. warrantly that the roof would be made watertight. He contended it was nothing of the sort. A warrantly to be binding. had to be expressed in definite words and could not be contained Lin the general terms given in the
letter.
Mr. Vaux said his contention was that the plaintiffs had con- tracted to mako "a thoroughly satisfactory job" of the roof and had not done so.
The Pulsne Judge: The dif culty in this case is that there has been 4 certain amount of dilatoriness on both sides,
Owing to one of the defendant's witnesses leaving the Colony, shortly, his evidence was taken first. Wong Ping-yu, the Owner of No. 4 Liberty Avenue, told the Court that the work to the roof was commenced about the begin- ning of June. After the first day, a ähower foll, and the workinen came and applied a second.coat- ing of Texacont. A few days later, there was, heavy rain and he discovered the roof still leak- ed.. Between July 21st and Sep- tembr 15th Mr. Lana, and himself applied another coating, obtained from a drum left on the premises by the plaintiffs' firm. This did not prevent the roof leaking.
On July 21st, heavy rain fell, "My house was flooded," the wit- ness atated, "and I could not sleep." All the walls in the back bedroom were wet. The witness. indicated on a plan the places where the water came in. He said he had refused to pay for the work until it had been completed properly. There was still a leak- ing in the roof of the house,
Owner Cross-Bramined.
In cross-examination by Mr. Armstrong, the witness said he, bought the house in 1928 and had a new wing constructed and the fold building renovated in 1926. At that time the roof did not leak..
Mr. Armstrong: Was there any rain then?
Witness No, it was a dry time. Mr. Armstrong: How long was it before the strike?
-Witness: Only a day or two,
Mr. Armstrong: Well then, you can take it from me that it did rain and rain heavily. That was the time when I marched for miles. In the ralo.

The witness said the leakage was at the edge of the ceiling near the wall. During the heavy rain on July 21st, both water and Texacoat came through.
Karl Henry Robinson, market- ing: asalstant for the Texas Com- pany, spoke of having Inspected. both the roof and the rooms of No. 4 Liberty Avenue. He produced photographs taken by him on the accasion of his vlalt, showing cracks in the parapet some: as wido as a quarter of an inch and several inches long. There were no cracks in the roof itself, and the Canton tiles were firm. Од the occasion of his visit after heavy rain, he found the walla inside noticeably moist, damp and stained, particularly in the corners, both in the rooms upstairs and down. There was no Isolated damp apote on the ceilings.
At the conclusion of the witness". evidence, the case was adjourned until 11 o'clock on Thursday. morning,
