"In my opinion the facts show clearly that the Arbitrator was well aware that the applicants desired to raise certain questions of law in the form of a Special Case. Arbitrator's Duties. Referring to the duties of an Arbitrator, His Lordship said he was given the power to state an award, as to the whole or a part, in the form of a Special Case for the opinion of the Court, and if directed by the Court should state in the form of a Special Case any question of law arising in the course of an arbitration.
No Definite Request. Without previous notice Mr. Little made his award, and asked whether he hid as part of his award stated the questions of law in the form of a Special Case, re- plied that the remarks of Messrs. Jenkin and Zeitlyn supported his recollection "that there was not a definite request from both parties that I should state & Special Case" and added "I have taken this course in the hope of avoiding un- necessary expense to both parties."
Mr. Little relied on the fact that the request had not been made by both parties, obviously incorrect ground on which to base a re- fusal to state a Special Case.
