PUNJABI ŠOLDİER ON TRIAL.
Pola Ram, non-commissioned officer of the 5/2 Punjabi Régimont, appeared before Mt. Justice Wood at the Criminal Sessions yesterday charged with the attempted murder of Sabadar Lakubram on Novem- ber 16. He pleated not guilty, and was defended by Mr. W. Addin.... Mr. T. S. Whyte-Smyth appeared for the Crown and in opening the case said that on the night of the affair the orderly of the wounded villeer was awakened by cries and on going into the room where his master was sleeping found him wounded on the bed. He called Whyte- help. Continuing Mr. Smyth referred to an Insident which occurred some time ago on the nockey field. The Subadar was referee and prisoner was playing. He was cautioned by tae referee, for rough play and threatened with being reported to the Commanding ollieer..
Caste Question. Referring to caste Mr. Whyte Smyth said it was the rule among Indians that, when recruited they should state upon an attestation form their caste. Prisoner on his stated he was of the Jat caste." When his name came up for pro- mation later the Subadar ques tioned him about his caste, asking him whether he was a Jut or whe- ther he belonged to another enste. He suggested that although these. were small matters the prisoner resented them.
When charged before the Magis- trate he denied having committed the deed and, went on to say that a man named Ram Singh was at enmity with him. Ram Singh was arrested at the time of the wound- ing but Ram Singh told the Police that he (prisoner) had done it and the Police then-arrested him. He thought Ram Singh.did that out of the enmity he bore him. In the statement he made at the Police Court he denied saying that he was threatened at mate to con fess.
Would Have Died.
"Major Lynch, R.A.M.C., was then, called. He spoke of examining the Subadar at 3.16 a.m, that night nt, the Kowloon Military hospital, He described the injuries and went on to say that the man would have been dead in an hour if he had not had attention immediately. The man was still in hospital and "unable to attend court.
A sepoy who gave evidence, said he was playing in the hockey match Feferred to. The Subadar caution- ed prisoner for rough play. 'Cross- examined he agreed that cutting the ball in the air was a common offence in hockey and that in his. opinion the referee rightly drew prisoner's attention to it.
Wounded Man's Evidence...
Mr. Whyte-Smyth, then read a deposition of evidence of tha wounded Grana. In it he said the prisoner was in his company. On the night of November 16 he went to bed at 1a.m., his orderly having gone to bed at 11-p.my in the ad- joining room. About 3 a.m. he wastawakened by someone hitting him with an axe. He did not know who it was. He remembered being removed to hospital bus did not remember anything else. He re membered the hockey match and remembered cautioning prisoner for rough play. In defendant's hearing he spoke to a non-com- missioned offer about the possi bility of prisoner appearing before the Commanding officer..
In cross-examination by Mr. Addis when the deposition was taken the Subhadar said prisoner was a good and obedient soldier. He had no cause for saying that the prisoner was the

At this stage the court adjourned until this morning.
