When the Police appeared on the scene the defondant seeriad to be in a' rather curious condition. He appeared rather dazed and smelt of liquor. He was opening and closing is eyes in a curious way.

The man who got hold of the de- fendant, continued Mr. Whyte- Smith, was a brother to the defen- dant and a partner in the firm.
