A report was submitted to the Senior Inspector of Kowloon and he, together with Dr. Pope, visited the scene on August 11. On the same day witness was ordered to "make a smoke observation."
Observations Made.
For one hour that, afternoon witness watched the chimpey and saw that during that period of time black smoke issued from the rear of the premises for 41 minutes while there was moderate smoke for only 19 minutes. This was. black smoke than there should have been."

A notice was served on the de- fendants to abate the nuisance thus caused by the excessive is sue of smoke but on September 3 after the expiration of the notice, witness again carried out a "smoke observation" and found that there was still 37 minutes when black smoke was emitted from the chimney.in one hour. A report was again forwarded. to the Senior Inspector and witness received orders to prosecuté.

In reply to Mr. witness said. that he had been a "Sanitary Inspector for the last three years and since he had been in charge of that particular district, having taken charge, about 18 months ago, the factory had always been there. He could not say if it had been there for the last six or seven
years.

Witness further said that the Shamshuipo. Police Station was only erected about a year ago. No complaints had been received from: residents in the neighbour- hood.
Mr. Lo argued that he had no case to answer although the nuis- ance did not necessarily have to affect anyone in the vicinity. The entire case depended upon facts and Mr. Lo submitted that there was no excessive issue of smoke from that particular chimney

In dismissing the summens, HU Worship said that he was unable to find that the chimney in fact constituted a nuisance. Lloensc had been obtained with difficulty and it was, presumably given be cause the locality was suitable for tho business..
In the absence of complaints. from residents in the neighbour hood and the absence of the con tinuity of the alleged offence, His Worship dismissed the summons.
