There was no corroborativè evid- ence, and if there was it negatived the idea, of Mr. Durand using bad language,

Mr. Lindsell said he agreed, and dismissed that summons.

Dealing with the police summons against Mr. Durand, Mr. Hugh Jones said defendant,was charged with fighting in the street. He submitted there was no evidence, and asked for that to be dismissed. His Worship said it was clear Mr. Durand was chased out of the cafe..

Mr. Hugh Jones said the police sergeant had stated that no, blows were exchanged.

Mr. Lindsell intimated that the police summons against Mr. Durand mast go on.

Regarding the assault on the police sergeant; Mr. Durand atly denied it. Here again there was no corroborative evidence, Mr. Durand had been upstairs engaged in a scuffle with Mr. Taylor and he was clearly running downstairs to got away from Mr. Taylor, who, on his own admission, was after him.

Not Act of Own Volition.

It was quite possible that Mr. Durand would struggle with "any- one in the street thinking It was Mr. Taylor or someone else inter fering. Mr. Durand, would be ex- cited, and if he did strike the police officer, it was not an act of his own volition.

Mr. Lindsell said he would con- vict on that summons.

Mr. Hugh Jones sald he then came to the summons which had caused all the trouble. This was taken out by Mrs. Taylor. Mr. Hugh Jones referred to the alleged kicking incident, and painted out that Madame Landau, who was standing near by, was not clear about what exactly happened, '· Such an incident would strike the eye of any woman; and bein- dellbly fixed in her memory.
