The women grasped the rudder but the men were alleged to have pushed them down with the re ault that they were not seen again and it is presumed they were drowned.
A small boy "an seeing the men attack the women, jumped over- board and after a four hour swim, he eventually renched Rocky Island and later returned to Cheung Chow,"
It was intimated at the first hearing that the men were not charged with murder because it was necessary to prove that some- one had been killed, and the Police, were not ina-position to do so as none of the bodies had been rocovered.

Defendants' Statements,
The case for the prosecution' having closed at a previous hoar- ing the defendants all made-state- ments implicating each other, at the same time denying setual participation themselves,
The first defendant accused the third defendant of committing the robbery. No. 1 was fishing and the third man came on to his boat without permission and forced No. 1 to row him to his destination. When he refused. the third defendant threatened to stab him. After the robbery had' been committed defendant return- ed to Cheung Chow, where he anchored for three days, after which he went to Lap Sap Mei to continue his fishing.
Although at first he had refused to accept any of the proceeds of the robbery he took a pair of gold bangles because of his poverty, On hearing that he was being acetised of participation in the outrage he went to Ching I and from thence he sailed to Mongkok by launch.
Second Defendant's Challenge.
The second defendant claimed that the evidence of the small boy was absolutely false.
He was carrying out his daily occupation of hawking potatoes and intended returning to Cheung Chow; but was prevented from going by the man who escaped arrest." The man suggested perpetrating a robbery, but defendant refused to accompany him on such an expedi- tion.
..
Having regained possession of his craft, defendant returned to Cheung Chow, while the man boarded the first defendant's boat and went to commit the robbery. The defendant knew nothing of the murder which was committed by the men.
In conclusion the defendant said that if the small boy still implicat- ed him in the piracy and murder. he must ask the boy to do so on oath,

His Worship: He has already sworn, what are you talking about?
·
Defondant: I challenge him to "cut off the cock's head."
The third defondant also placed the bulk of the blame on the man who had escaped arrest.
He stated that he and the first defend- ant who went willingly, committed the robbery. It was the first de- fendant who asked the other man to gó: Witness himself was forced to go with them, but he was not responsible for the deaths of any of the people on board the victimis. éd bout.
All three defendants were com- milted to take their trial at the next sitting of the Criminal Ses- sions.
