This particular reader had let) nis garage, patrol and oil bill extend to such unfortunate extent that on calling for his car at the week-end the garage proprietor refused to let him take it out unless he paid the hill. Faced with the donoying alternative, he' sal.

So far as the law is concerned, the garage proprietor either wil- fully or unknowingly, ran a bluff, which in this instance came bff. But if the motorist had still refused to pay his bill, and the garage proprietor had still refused to let the cur go-the law work have been avifh the motorist,
For such a sight the legal proca- dure is to sue' in 'the ordinary way. There is no right of lion in such a case, and the garage' pio. prietor must let the cargo, even if he feels that he is concurrently letting his account go.
THE DIVIDING LINE.
But in this respect, as in all other things, circumstancos alter
cases.
If the bill, or part of the bill was for repairs, or work involving! actual improvemont to the car, and those. repairs were done in the garage proprietor's own.repair promisos, then he could legally demand such money before part- ing with the car.
If the repairs were done at the roadside, or oven in a lock-up garage belonging to the repairor, but rented by the motorist, then no legal claim for payment before taking the car could be maintain- ed.
And that state of affairs would still hold good if the car had to be driven through the repairor's gen eral premises in order to get on to a public highway.
In the average car maintenance: agreoments the law is
very similar. That Is to say, replacing a worn part does not count as "improving the car. The legal compatison is made with tho original state, of the ear, so that such a repair is not a legal "im- proyement"; and consequently no lion can be substantiatod
