RECENT HOME JUDGMENT.
Mr. Justice Sankey recently. gave judgment in favour of a Mr. William Holmyard, who claimed. pos&casion of a leasehold house at Hampton-road, Twickenham, which had been demised to him by the defendant, Mr. William Chindler Grover, by way of mort gage on January 18, 1926, to secure an advance of £460, made by the plaintiff to the defendant. There was also a claim for "the repayment of two sums of £50 and 215 advanced by the plaintiff t the defendant in February, 1925: for which the defendant had given two promissory notox.
The defence was that the mort- gage had been executed and the promissory notes given for the purpose of securing betting debta owing by the defendant to the plaintiff in respect of betting transactions between them, and that, therefore, the mortgage was executed and the promissory notes given for an illegal consideration: under the Gaming Act, 1835 (5 and G Will. IV., cap. 41, sect. 11. The defendant also counterclaim- ed for the mortgage to be set aside; for a declaration that the indenture was executed for an illegal consideration; and for an order that the plaintiff should deliver up the title deeds of the house to the defendant.

The plaintiff, in giving evidence. said that he was a furniture dealer and a bookmaker. He had had business dealings with the défen- dant extending over 15 years, but There had not been much betting between them. Five years ago the defendant had come to him and said, that he wanted to com- mence # betting business Twickenham, and had asked him (the plaintiff) to lend him money nn his title deeds. From that. time. onwards the defendant used to arrive at his the plaintiff's) house at 7.30 in the morning and Complain that he had had another bad day betting, and that his wife was extravagant and wanted money. He also complained that he had lost a considerable sum on football betting and that his men hal cheated him.
Mr. Justice Sankey. He seems in have followed horses and gone to the dogs.
In cross-examination, the plain- tiff said that he did not keep any books, and that the betting he di was ready-money betting.
The plaintiff's housekeeper and his solicitor gave evidence corro. borating the plaintiff's story of the circumstances of the loans to the defendant.
The defendant, în his evidence, said that he had had betting trans- actions with the plaintiff for the last six years to such an extent that he had been obliged, to sen his house at Brighton for £680.- What he owed the plaintiff in January, 1925, was for betting.
fa cross-examination, he admit- ted that he had lost by betting on football contingencies, and that the plaintif had handed him £10 in the presence of a solicitor to pay those bets.
His Lordship, in giving judg ment, said that the real issue was whether the money, or any part of it had been lent by the plaintiff in respect of betting transactions between the parties, or whether it had been lent in order to enable the defendant to pay a bet that he had already lost, or for some other legal consideration. It har been decided as long ago as 1875
in ex parte Pyke in re Lister
(8 Ch. D., 754) that money lent to enable the borrower to repay la bet already lost did not con- stitute money lent for an illegal. consideration.
If the plaintiff made out the caso that the money was lent to the defendant to enable him to pay bets that he had lost, or for the other redsons that he had stated in his evidence, there was no question that he was entitled to the relief claimed.. Having regard to the plaintiff's evidence," as supported by the evidence of his housekeeper and of his solici- tor, and also to the facts that the defendant had admitted that of the 4450 in question £100 had been lent to him to enable him to repay àrum he had lost by betting on football contingencies, and that a

plaintiff had been endorsed by the defendant himself, with one excep- tion, he (his Lordship) was bound to accept the plaintiff's version of the transactions between parties. There would accordingly be judgment for the plaintiff.
