Yatke, a Filipino, on a murdor charge in connection with the death of Harry Kidder, the ap- palate court to-day hold that a white woman could not legally become the wife of a Filipino and therefore could not be excused from testifying against him on the ground of marriage. Defense counsed based its appeal on the ground that Yatke had been con- victed largely upon the testimony of his wife.
