This and other hospital teste for sobriety were ridiculed by Mr. Hayes, counsel at the Old Bailey recently, defending a motor driver alleged to be drunk.

He described the tests now ap- plied as "old-fashioned muddling. popular in the Victorian era, but utterly unsuitable for a serious charge."

He said he had tried the bose- touching test the previous day. "and was unable to do it with my eyes open."

Another test, he went on, was to say "British Constitution."

"I did not know before that it was a difficult and nasty word to say late at night," he said, "and it is obviously a term to avoid is

an after dinner speech.

"You might as well ask a man to say Sister Susie sewing soldiers' shirts.""
