January 5th: To-day the Chief Justice delivered judg ment in the appeal by the defen. dant in the suit of Lucie Jacob against David Alexander Wills for alleged breach of promise of marriage against the judgment of Mr. Justice Buckland,awarding Mrs. Jacob R«. 35,000 as damages. Plaintiff was a widow, She was « German by birth but married in England a British subject Jacob. who died in 1913. Defendant was an assistant in the firm of Heilgers and Co. of Calcutta, They met at Simla and it that originally intended the marriage should take place in October 1915, but before that difficulties had arisen by reason of the war with Germany ard the Germen origin of the plaintif. Mr. Justice Buckland held that the parties bad agreed that the marriage should be post- poned until after the termination of the War.
