SUB-CONTRACTOR'S CLAIM.

An Interesting Judgment.

Judgment was this marning given by Mr. Justice Gomparts, in the Summary Court, in an action brought by Li Yan Ke against Li Wah Hing (trading a the On Hing firm) for balance due for work done as sub-com- tractor.

Mr. Justice Gompertz said÷- The plaintifa claim is for the balance due for work done by him as sub-contractor to defendant

The defence is as follows: On the 7th. February, 1921, being the eve of China Now Year's Day. the plaintiff's representative was present with other creditors at the defendant's shop. The defendant announced that he had no money, but that | he bad managed to borrow the sum of $2,000, out of which he proposed to pay his creditors about 20 per cent more or less of the amount of their claims, aggregating roughly $10,000, if they would agree to take it in full satisfaction. If this offer was 10-| fased, he would' fite his petition in bankruptcy. The arrangement was not at first accepted and there were many complaints. Finally, however, all present except two persons agreed to a present payment in full satia- fation of their claims. The de fendant's sccountant then made a list of creditors with the amount receivable by such. The list was theaded as follows:-
