CURIOUS CASE OF SHIP'S CARPENTER.

A somewhat unusual type of case has been decided at the West Hartlepool County Court The plaintiff was a ship's carpen-

who claimed £100 from the shipowners who employed bim, for wrongful dismissal. It seems he signed on for a "voyage not exceeding three years, to end at some port within home trado limits." He was discharged with the rest of the crew at Mombasa, their places being taken, it was stated, by coolies. The Judge who tried the case said the three years did not expire till the end of 192, sad he had to decide whether the captain could, in the circumstances, be said to have brought the voyage to an end in Mombasa. He did not agree with the suggestion that the abip was really engaged on a succession of Voyages, each complete in itself, and that at Mombasa one of the voyages came to an end. The voyage" contemplated by the articles ander - which plaintiff signed on comprised, he bald, the whole enterprise on which the hip was to be engaged from the time she left England to her re turn bome again, such enterprise being that of trading from port to port-abroad, and this enterprise. had not been abandoned. There fore, he ruled, the "voyage" con- templated by the contract.was still continuing. Plaintiff 39 129– engaged for the whole voyage, and had been discharged without rond cause before it was brought fo an end. He was, therefore, ntitled to damages for, wrongful Jismissa), and was awarded £90 and costs.
