AY INADEQUATE EXPLANATION.

In opening the case for plain- tiffs, Mr. McNeill Inid stress upon the fact that defendants admitted that the Yingchow was as close as she could be on the port side of the channel, which was a patent breach of the barbour re- lations. If her only explanation of this was that, at a distance of half a mile, she saw a vassel being hanted out from the wharf, it was hopelessly inadequate.

Capt James Budgen, pilot of the plaintiff vessel, said that the photographs correctly represented the positions of the vessel just be- fore" and just after the collision. He gave general confirmation of the case set out in the statement of claim.
