Hon. Mr.C.G.Alabaster, O.B.E, instructed by Mr. J. Hall, of Messrs. Wilkinson and Grist, appeared for plaintiffs. There was no appearance on behalf of the owners of the ship.
Mr. Alabaster said this was an Admiralty action of closure of a mortgage
ship for non-payment of the prin- cipal sum
and interest and certain expenses that the mortgagers had been put to. There had been no appearance entered on behalf of the owners, and there was a certificate of non-appearance on the file. An order was made on January 9th. that the plaintiffs should be at liberty to proceed to trial e parte

On 25th October last year the second plaintiff, who was also the Secretary of the first plaintiff, the Company, gave a month's notice, as required by. the mortgage, calling in the principal. November 24th was the date for repayment, and there WAS a condition requiring month's notice of payment calling in.
