to the identification of the accused they had two witnesses, one the son of the deceased who was walking some paces in front of his father and heard the call "save life. The other witness was a man who was walking in the neighbourhood who would say he was a witness to the stabling as having been concerned in the stabbing and had identified
the third and fourth accused. The case for the prosecution rested upon the evidence of the identi- fication of two witnesses. The cccused when charged at the Police Station said "We were not there at all."
In reply to His Lordship, the Attorney General said that the theory of the prosecution was that the accused were concerned with the quarrel between the two different Rattan Workers' Guilds.
Evidence was then taken.
After the case for the prose- cution had concluded, Mr. Alabas. ter submitted that no case had been made out by the Crown against the second accused, Wat Sui So.
The Attorney General agreed and His Lordship accordingly discharged the prisoner.
Mr. Alabaster then opened the case for the defence.
The case is proceeding.
