Calcutta Port Commisioners Sized.

On December 3, Mr. B. O. Hita, 5th Judge of the Calcutta Small Canes Court, decided the wait of Messrs Turnbull (Glasgow) Ltd, against the Port Commis aioners. Plaintiff Company sought to recover the sum of Rs. 29 the value of a bundle of corrugated iron sheets lost in transit between the Calcutta jetties and their yard st the Kidderpore docks. Mr. 8. A. Gomes, appeared for the plaintiff and Mr. Langford James for the defendanta. Mr. James arged the following among other grounds on behalf of the de fendants--First, a requisition form for supply of wagons by defendants contained clamees amongst which it was stipa- lated that the Commissiomers took no risk in carriage, and sonders have the right to send a man to look after the goods în transit. Secondly, if the Port Trust Rai- way were governed by the Rail- way Act the defendante had not been shown to be negligent. Thirdly, there was not sufficient proof of the loss. Mr. Gomes, for the plaintiff, contended that the clanses required the sanction" of the Governor-General in Council and no sanction had been filed by the defendant. The loss was Bmply testified and if the defend- ants could not give the quantity of goods carried by their railway they should account for the les or pay their value."
