Douglas Lapraik & Co. General Managers.:

was caused by the grave error of judgment of John Howson, the master, inasmuch as when at 4 am on the day of the stranding, he saw that the weather condi tions at that time were so bad,

and likely to leat, and with a

strong gale blowing on to the fand he was not justified in at templing to pass inside of the Lurcher Shoal, especially as he was practically ignorant of the onditions of the tidal streams in that locality. In the Court's opinion he should have hauled his vessel out to the westward, into deep water, where there waE ample sea room to handle, his vessel until such time as the weather cleared, or he was able to proceed with safety. He was not justified in assuming that the Lurcher lightvessel, was not on her station on the morning of the Stranding simply because she happened to be away from it un- dergoing the usual annual repairs and overhauling, when he passed down the Bay of Fundyin November last. She is a perment- ent aid to navigation, as is shown in the list of lights, etc., and an the Admiralty Charts, and was on her station at that time,

The Court severely censured the master, but on account of the very efficient and satisfactory manner in which everything was carried out on board his ship for the enfety of the passengers and crew, after the stranding, did not deal with his certificator It added that it was dufortunato. that the manter was unable to give the exact position of his veasel by wireless when she the stranded, although unde weather conditions it would not appear that a rescue could have been effected much before, the time when it actually occurred,
