The decision will be a great aid to the im migration officials who are not al waya successful in deporting undesirable Chinose under the act which provides for thom alone.

The decision was enade in thẻ Case of three Chinamen, who wore nerosted on January 17, alter they had crossed from Canada'in a rowbont. Their arrest was made under the general immigration law. One of thom, Ng' Kwan, was deported, but the other two, Wong Jong Ying and Moon Hing Ak, ratainod fórmor Assistant United States District Attorney J, V. D. Willcox and Attorney O. A. Howell as counsel, and they pati tioned the court for a writ of labeas corpus.

The oase was argued before Judge Swan with Assistant Dis trict Attorney Blund representing the govorument. The petition was denied.

At the country jail three other Chinamon, Jim Gaw, Moy Fong and Ah Look, who were arrested March 16, at the Michigan Cen- trol station, after crossing tho river in a box car, appeared be- fore Immigration Inspector Char les Ego, oharged with violation of the general immigration law.

Whether a case of this sort may be appealed no one seems to know It is the first case of this sort in this circuit, and the attorneys are not familiar with the method of procedure under the circum- stances.

It is said that a mandamus may be secured to compel tite judge to issue the writ of habeas corpus, but as the writ has not been issued and the petition for it donied, the casa cannot now be appealed to the circuit court of appeals at Cincinnati, the court of last resort of the sixtli oircuit, p
