Mr. Fetter stated that under the Crown Office practice, where a man was in custody, the Court should be semmoned by writ of habeas corpur to show cause why ball should not be granted. Even when a prisoner pleaded guilty, there was inherent power vasted in the Court to grant ball. There were two ways of asking for bail, ons of which was when the Court originally exercised its fatisdiction to grant bill.
