THE MADISTRACY

Before Mr. E. R. Halifax, First Police Magis trate, this morning, George Thyno, late First Mate of the ..Derwent, was charged at the instance of Capt. Jenkins, master of the s.. Dervent with the alleged embezzlement of a water closet pipa belonging to the ship. Mr. E. J. Grist, of Messrs. Wilkinson and Grist, prosecuted and Mr. P. W. Goldring, of Messrs. Goldring, Bar low and Morrell, appeared for the defendant.

Mr. Goldring stated that never heard of

such a charge.. His client had already an swored charges of misconduct and been found guilty of selling part of the abiple fittings and converting them to his own use and making cériain structural alterations and his' certificate bad been ordered to be suspended for six months. He submitted that it was perfectly clear that once a man was convicted the same charge could not be brought over again."

His Worship-The charges cover the same ground?

Mr. Goldring-Absolutely the same ground Mr. Grist submitted that Marine Courts of Inquiry, merely dealt with the question of searmen's certificates. It was really a Board of Trade loquiry. It did not to any way take the place of a Criminal Court, It had no power to loflict imprisonment..

Mr. Goldring-Oh yes, they have. His Worship-They have full power, Mr. Grlet,

Mr. Grist contended that the Court was almply an inquiry into the competency or otherwise of the mate to hold his certificate. The defendant did not stand his trial on any criminal offence. He had not been charged with that particular offence,

Mr. Goldring submitted that the summons said that the defendant was charged with un" lawfully converting to bis own use, etc.

His Lordship (To Mr. Grist)-If you wish to preas the charge, you could bring it before the Harbour Master in the same way as the origins! charges.

Mr. Gritt-The best way would be to bring It before a Summary Court.

His Worship—I think that is the best possible coura. I am afraid we have no jurisdiction. You don't wish to press the charge?.

FIGHT ENDS IN TWO MEN'S ARREST,

Shortly after eleven o'clock last Wednesday night, Jardine's Bassar was thescene of a serious quarrel between two men who are supposed to belong to that hotbed of discontent known as the Triad Society. It appears that the mes had "am" trgument over some money, which toon developed into a heated altercation, in the course of which one of them was savagely at- licked by his compatriot and sustained a nasty gash in the region of the skull. The other man, who had by this time becoms infuriated, retaliated by stabbing his assal'ant in the sido with a knife. Some time intor, the body of the latter victim was found lying in a prostrato condition on Jardine's wharf and the part where the injuries bed bean received was found to be biceding profusely. Someone had tied sush round the wound, which appeared to somewhat staunch the flaw of blood from the w-dad. The Police have arrested both man, who will be charged before a Magistrate as non as they have sufficiently recovered from The effacts of their wounds.
