Mr. Bowley said that he understood that Mt. Grist for the defence was going to raise a prell minary objection on the ground that the de feddars was a Chinese practitioner.

He submitted that Ti Chup and the name of the prisoner was there could only be one meaning conveyed by Wong Yok Shi, otherwise Wong Hung Sin. the words "Chinese practitioners" of Chinese The date of the death of the deceased brother

was the 9th September last and he died at nationality. Defendant married a Chinantan ten years ago in the Chinese registry of Hong-place called Kwok Tal, in the Empire of kong and was therefore entirely exemplad, They were dealing with a penal stature, which aught to be coonteued most strictly. Defend ant was of Chinese nationality and therefore she had committed no ofance. He did not know whether the prosecution admitted that defend sat wat of Chicase nationality, but it was lald dawn distinctly that if a woman married a Chinaman or a man of any other nationality, she adopted that nationality.

There was no doubt about it.

Mr. Bowley said that the Ordinance was framed with a view to provanting mischief Before the passing of the Ordinance, there was Bo check upon the practice' of medicine la the Colony. He did not wish to fun down the Chinese form of practice; they were double Its very skilled but they entirely disclaimed surgery. The Ordinance also sought to prevent Bon-Chinese from setting up a practice in the Colony. The question of nationality did not enter into the casa stall. In Sir Francis Pig. goit's book on extra-territoriality, it was dis- tlacily stated that marriage had no effect on DRIionality. The prosecution would be in position to prove that defendant attended on a certain lady, who, unhappily, a dead, and advised her. She prescribed for, her to be ordinary way just an any other practitioner would have dose and did not advise Ber According

the Confucian method at practice, bat practically as an American lady doctor The defendant held an american medical diploms and was known as Dr. Lamb, De- fendant belonged to the American race and was of Anglo-Saxon stock and it was extremely unlikely that the defence would allege that the defendant bad Mongolian blood. It was aximordinary under those circumstances that defendant should have colered a plea of be tonging to the Chinese nationality,

Mr Grist contended that nothing was men. tlobed in the Ordinance with regard to the ques. tion of race and method of practice. Any man could practice according to whatever method be liked.
