After Mr. Harris had outlined the alleged facie of the cass, the plaintif was called to the stand, Ha declared that he was in defendant's employ. mant, and worked from saven a.m. until ion p.m. daily. He joined the firm in November, igos, having signed an agreement in Bombay. He remained in defendant's service until the 3th April, when he was discharged, because lie returned to the firm late one night.
