A somewhat interesting action was brought In the Supreme Court, last Monday, the Chief Justice (Sir Francis Piggaui) presiding. in this case, an application was heard on the part of the defendant (Fung Wa Chun) for an order that the statement of claim filed on the 31st November last be struck out on the ground that it discloses no reasonable cause of action. and that the action be dismissed with costs to be taxed and paid by the plaintiff to the defend. ant. The Hos. Mr. H. E. Pollock, K.C., who was instructed by Mr. G. Jackson, appeared for the plalati bila Sir Henry Berkeley x.c, assisted by Mr. Shenton (of Massis Deacon, Looker and Deacon) represented the defendant.
Sir Henry Berkeley said that the case was ons of defisse. The nature of the action was important, owing to a certain allegation is the statement of claim. Sir Henry's contention in brief was that the action was wrongly brought, se an actios of datlave could not be brought without the plaintiff owning property (In the shares), which was not the case ia the present action. The statement of claim razde as follows:- 1. The plaintiff is a married woman residing at No. 45. Csing Road.

5.In or about the month of October 1905, the plaintiff's husband, pe Chau Tang Shang, mado a gift to the plaintiff of go shares in the Canton Land Company, Limited, which shards were registered io hir name, and the said Chan Tung Shang in the presence of the platutiff banded to the defendant the certificates for the so shares and also certificates for 14 other shares in the said Company, which were lika- wise registered in the name of the said Chau Tong Shang and were the property of the plaintiff, and the said Chau Tung Shang at the same time requested the defendant to get the. çó.abures and 14 shares, in all 64 shares, trans. ferred out of the name of him; tha said Chau Tung Shang, into some other name and to de- liver the fresh certificates, together with blank transfers for the same, to the plaintiff on her request, which the defendant agreed to do.
4. In or about the month of December, 19a8, the plaintiff handed the certificates and blank- transfers attached thereto for 250 shares in the said Company to the defendant for the purpose of the defendnot holding the same in' safe custody to and for the use of the plaintiff, and re-delivering the same to the plalotiff on har request, which defendant agreed to do,

an agreement la writing dated Kwong Sul, 33rd year, rat moon, 20th day (14th March, 1907) the defendant agreed with plaintiff that he would within two months from the. data of such agreement deliver to the plaintiff the

6. The plaintiff bet repeatedly requested the defendant to deliver up to her the certificates and blank transfers relating to the said 314 *shares in the said Company,
7. The defendant, however, notwithstanding the matters aforesaid, and notwithstanding the sald agreement, has failed to deliver, to the plaintiff the certificates and transfera relating to the said shares or any of them and bas de- -tained- the" sama from the plaintiff and has
