At the re-trial, Mr. J. H. Gardiner, of Messrs. Brutton and Hell, appeared for the defence, and he proceeded to show, after evidence bad been taken, that there was no case for a jury; that there was no evidence to convici, and that the charge was brought against the defendants by Chinese policeman 299, who had a grudge against them.

The story related by the defendant policeman was that he and No. 199 were not on friendly
