PUBLIC HEALTH BILL...... The Council resumed Committee on the B}ll-entitled-An-Ordinance.to.amend the Pub- lic Health and Buildings Ordinance; 1903, and the Public Health and Buildings Amendment Ordinance, 1903,
The following were the proposed additions "to clauses 84 and 88 of the new Poblic Health and Buildings Ordinance, postponed at the last meeting of the Legislative Council as the result of a laiter which had been received by His Excellency the Governor from the Chiel Justice, Sir Francis Piggott, who commented on costain aspects of the debate which took place at a previous meeting of the Council and which His Excellancy said raised several constitutional points which deserved serious consideration:
"Provided that nothing bersin contained shall "be deemed to prevent any person from apply, Ing to the Supreme Court for a mandamus, lojunction or prohibition should he elect to do so instead of appealing to the Governorin Council under this section "
"Provided that nothing-herein contained shall exempt any person from any proceeding by way of mandamus, injunction or prohibition."
The clause was introduced by the Hon, Sir "Heory Berkeley, K,C.
The Attorney-General said that considera. tion of clause 85 had been postponed as His Excellency had, informed the Committee at the last meeting in order that a letter which had been received from the Chief Justice who had raised apolat requiring consideration might be discussed. The Chief Justice sug- gested in effect that the clause should be amended, so that the finding of the Court in cases referred to it might be carried out. The effect, of this would be that all the Common Law remedios would be specially reserved. There would be the right of appeal to the Governor-in-Council and the Governor-in-Council would have the power to state a cake to the full Court on any legal point. The Government did not consider there was anything objectionable in the amendment proposed.
Mr. Pellock thought it was desirable-that
