Extradition proceedings depend on statute alone. It is not sufficient merely-to-have-got-the-mea-in: custody for, some other offence; and then to' atart extradition proceedings against him on suchan order as this for there would be nothing to support those proceedings. The requistion 10 nothing but the foundation of executive action; the order of the Governor is nothing but the executive request to the law to aci ; the warrant is the first and only step on which extradition proceedings can be started. With out a warrant everything which is done is absolutely bad. No Courts in any country have any the smallest jurisdiction in the malter of crimes committed in another country. The treaty gives them none; but only the legislative act, which authorises the executive and judicial acts necessary to fulfil the treaty obligation. Asd when that Act mys that a warrant is necessary, a warrant there must be, and that is all about it. there is no warrant the proceedings are bad ab initio. I have heard it said that if you can get hold of a criminal by come means or other the Courts can act. It certainly is not so in extradition proceedings; and of this I am cer tain that no policeman could arrest the fugitive without a warrant, even though there were requisition and Governor's order thereon.

I do not agree with the argument that the words "already in custody" mean in custody on some other charge for the Magistrate would have had to issue bis warrant on the Governor's order. Again the warrant which the Magistrate did issue under Section & for some reason is called a provisional warrant and the word "provisional, if it has any meaning, must mean that something additional is required. To perfect it, viz, the order, which is absent here, on the warrant was never per- fected. I do not think that the remand orders of the Magistrate aro equivalent to the orders referred to in Section and therefore I, de not think that the procedure laid down in the Ordinance has been allowed, and that the man is illegally detained. Alen, I do not think that the original information was sufficient la justify a warrant,
With reference to the question of an ante. cedent, engagement, I am still of opinion that the cases of Bouvier and Alice Woodhall
There is no such maxim known to the law as that a wrong may be committed in order (bai right may be subsequently done. I aliude of course to a wrong committed on our own soll, for with wrongs done in connection with extra dition-in-another-country-our-Courts could have nothing to do. Our law boasts that for every wrong committed within its purview there is a remedy. But in this case illegality is said to be condoned by subsequent legality, irregularity justified by subsequent regularity; I cannot understand the doctrine. Extradition is the voluntary surrender by the state of the |"right of asylum" in any special case under a trasty. This right is no ardent figure of speech §. "it'is the consequente of the fundamental doc- trines that all crime is local, that criminal laws are territorial, and that no country will enforce the criminal laws of any other country. Tokio, February, 20, The Japanese Consul at Canton has rejected the Viceroy's proposal that the question of the rest of the Taiss Maru should be submitted to arbitration, and has demanded the im mediate release of the vessel.
