TRADE-MARK DECISION,
The Official Gazelle (translated by the Japan Herald) publishes the decision of the Palest Bureau in the petition filed by Mr, H. Irving ⠀⠀⠀ Bell, late representative of Mosats. Jarding, Matheson & Co. No, r, Yamashita-cho, Yoko-
ama, claiming invalidation of a certain tradestà, mark (Registered 'Na-26,016), registered by Mr. Yasuda of Nagasaki. The petitioner coo tends that the trade-mark in question closely resembles the Russian national flag'and Thám? fore comes under the purview of the provistonk of Articles II-2 and X. of the Trade Mark Law. The Russian national flag bears the in- slgnia of a diagonal cross on white ground. The only difference between the Russian Ang ard the trade-imark is that in the latter the, diagonal cross is mounted on a
a coloured gerund the two being exacity similar in shape, As the Trade Mark Law does not concern, itself with colours, the two can be laid to be in close resemblance with one another,
The respondent contends that the trade mark is composed of a diagonal cross mounted on white or black ground attached to the top: of a thick flag-pale with a knob.. "It is an original design, so that the petitioner has no cause for claim.
The judges in the Patent Doreau dismissed the petition on the following grounds: The point at issue is whether the trademark resembles the Russian national flag or other wise. On careful examination we find that the tride-mark in question is a mark representing a fláz with a diagonal cross in white mounted. on a coloured ground. Although the mark Pesembles the Russian military flag, it does by. no means resemble the Russian national flag. nor does it represent the national "Aag. of any other independent country. On this
round the trade-mark.cannot be invalidated. in accordance with Article 1 of the Trade, Mark Law."
The decision is dated October 13th.
Here is another-example such as, we have repeatedly called attention to. The judges of The Patent Bureau persist in regarding the words of the Trade Mark Law which forbid the registration of marks "similar to" as if the
1985 reading was "identical with," Thus all that is necessary is for some quite immaterial: altera. tlon, which does not affect the general appears ance at all, to be made in a well-known trade mark, and it can be registered without more ado, no matter that it is clearly intended. 10 deceive unwary purchasers.—Japan Chrosicle..
