relating to the admission of attorneys to the Bar. On both of these occasions Mr. Curtis was informed by the Court that if he would file a petition with the Coult it would receive due consideration. Prior to this time Mr. Curtis had served notice an the Court privately of his intention to test the rule of the Court by mandamus proceedings in the United States Circut Court of Appeals of the Ninth Circuit. The records of the court also show that Mr. Curtis was in Court: on the tenth of June last when an examination was held under the rule; that he did not comply with the rule but after hearing the questions and auswers i › open-Court, arose and asked for an examination to which the Court replied that the examination was concluded, but that if Mr. Curtis would file his application and certificates of character in compliance with the rule they would receive careful consideration. (See Mi- nutes of the Clerk, june toth, 1907.)

Mr. Andrews said he appeared for 'Mr. Curtis, and on his behalf wished to note ant exception to his Honour's decision, in so far as il concerned Mr. Curtis, and Counsel wished to give notice of appeal to the United States. Circuit Court.
His Honour said the append would be noted, but the Court Mambail would see that the judgment was carried out meantime.
Mr. Andrews-We will of course be perfect- ly willing to pay the fine, but it will be paid under protest.
