Mr. Pollock briefly reviewed this case which, will be remembered, arose uut of a mortgage which was alleged to have been executed by Long Kee in Hongkong, at a time when it was proved that he was then in Australia, and knew nothing, about the mortgage until after his arrival in Hongkong, when he received in incompréhensible letter from Ng Wais solicitors sequesting repayment of the caphat and interest on the 'mortgage to save forei closure. He then found that the title deeds of the mortgaged property which he had left with his wife in Canton had been stolen.
The Chief Justice: But' will the costs cover the amount necessary for an appeal to the Privy Council?
Mr. Pollock: We cannot possibly say till the bills are made out and taxed. But our costs alone will amount to over $4,000.
