THE SHANGHAI TRAGEDY.

ADURESS FOK tile defence.

Mr. Andrews in a very lengiby address to the jury, dwelt minately on every portion of the evidence given by accused and Mrs. Rose" alluding to the tender attachment actured had for Mrs. Rose, and his manly desire to save the gle! from ruin. A few weeks ago there was not a breath against the accused. He had his" family, his home and his betrothed, Mrs, Rose, who was only a poor girl, was probably attracted by a man in a much superior position, in life running after her. They could see from her behaviour in Court how sorry 'who was and how she laid the blame on herself. Accused's action bore the imprint of every endeavour to save an innocent girl; to protect his betrothed; and it was nothing but the action of an honest mas and it could not be construed as the action of a murderer. He had gone into the conflict unexpectedly and fired for his own

self protection. He had acted as only a rea- sonable man would and if the jury came to" that opinion then they would acquit him. There was the evidence of a gun, and a sword having been in the house-and afterwards a revolver. One might as well have attacked.. that house as a fortress.

The crowd present in Court who appeared throughout the proceedings to ba particularly callous here burst out laughingwhich died away when His Lordship sternly rebuked them, say having arrived from the above Ports, Coning:-We must have silence in the Court. This is hot the way to behave in a solemn case of signees of Cargo are hereby informed that their Goods will be delivered iram alongside.

Mr. Andrews, continuing, said that re Krettable as this tragedy was, had it not been shows that Smith had brought about his own death bỷ bis van acist Would not any man have done what the accused did in order to protect his own loved one? Let them ask them.. selves what they would have done under sim ilar circuinataqces; let them think of the wo try it caused to the young man who stood befo re them and who had already been incarcerated, who had been confined in a gloomy cell ever since with all his mind at high tension and they would by he had already been punished. With these few words he 'confidently left his case in the hands of the jurors.

Mr. Home touched on the questions of law, but was scarcely audible from the reporter's: bench. He said his defence was that Hynd. man believing that it was necessary for his own self-defence shot off his pistol at Smith and secondly-a subsidiary defence that there was provocation which was not murder but manslaughter. Then there was accused's state of mind: was it in another state to what it ordinarily was? Counsel also allured to accused's good character

There were three verdicts which could be given:-The first-"guilty” on" the charge mide, nithely, that of wilfully kili. ing and murdering Harry Smith. On the other hand they might come to the conclusion that charge was not true which would mean mandlaughter or self-defence, the latter being "not guilty". lu'speaking of the persons engaged in this tragedy he would say that Mrs. Rose was a woman he could not speak of with great respect. Shortly after her husband's death she became engaged to the accused and while on affectuate terms with him went to the deceased's rooms for no good purpose and there

an intrigue with Mrs Rose. Regarding ac cused, he had been, here a number of years and nothing bad was known of him and so far as any testimony went he had been Tha a steady, hardworking young fellow. first question of course was the cause of death. There could not be much doubt but that ac- cused fired the shots und -hit he "Villed Harry- Smith. Now two defence, lad been raised :- that the killing of Harry Smith was lawful be cause it was in self-defence; and, secondly, that the circumstances were such that he was out of control of himself and under great provocation,

His Lordship here dealrat length upon the definition of the term self-defence as laid down by lay:-::

-

The relation of Mrs. Rose and the prisoner"] were very material, Evidently he had loved! her a long time and was on affectionate terms with her. His worship drew attention to thi letter found on accused to his father, their res lations were most honourable. Then Smith appears upon the scene in July and opens up. an intrigue with Mrs. Rose. There was nothing to show that Hyndman suspected this intrigue or that Mrs. Rose would fall to Smith's desires. It had been shown what Smith's desires were when he asked her to go to Japan with him, Then the drugging of which Mrs. Rose spoke about, but that was an isolated fact, but this Jatter was a point lo which too much attention. - should not be paid as ft had not-beau proved. There was the provocation when accused saw his betrothed on the bed with her dress off, her helt unbuckled and ber hat on the mantel; when, in the passion at such a sight and under the excitement of the moment he might have drawn the revolver and shot. It was possible be oever had the intention of attacking Smith until the sad sight of ble girl partly undressed on the bed. With regard to the curious document addressed "to whom all it is may coocera" it was possible he thought be might be killed by Smith in trying to rescue" bis girl. If they thought that accused set out for the purpose of redeeming his ́ sweet. heart rather than that of punishing his rival and being transported by what he saw"drew kis revolver than they could only find him guilty of cannalaughter.
