The Hon. the Attorney General said that The lacts briefy were that in June, 1904, pri- soner was anested as being a rogue and a vagabond, and was sentenced by the Magis trale to three weeks' imprisonment, and
up a huge stone and brought it down several to be banished on the expiration of his sen- times on his head, causing great injuries tence, for a period of five years. He was this skull. His actions were noticed by a banished. On the yth of September, this minih, he returned in the Colony, and was a once arrested. Now, in the Ordinances, of this Colony was a very useful and proper clause, which he, the Attorney General, did not think was included in the laws of any otter British Colony It provided for the protection of the lives and property of the inhabitants, by giving power and authority to the Magistrates to get rid of undesirables by banishing them from the Gelony. This was very necessary here, as otherwise we might be inundated with all sorts of undesirables from die interior of Chida, In the case of the prisoner, he was banished by order of the Magistrate on the 25th June, 1904, for five years, but, he returned with-- in that period; on September 9th, 1905. He was banished under the name of Li Hong, but he now said his name was Hi Fu, alias Tse Fu.. So the natier turned upon the question of identification. In this regard the police had a very perfect system for identifica. tion. When a man was ordered to be banished he was photographed, and the photograph was filed in a book, together with a full description of the banishee, and describing any marks, ears, Wounds, lost teeth, etc., that might assist in his identification. It was therefore for the jury to consider, after hearing the evidence, whether the man in the deck was the returned banishee,
י,
Police evidence was adduced to the above effect, the photo and description of the man were produced, and the jury retired to the Bar Library, and there examined the man, com paring his features with the photograph, which were identical, as were also the marks found on his body, with the official description. Thus the prisoner's plea of mistaken identity at once fell through. When they returned into Court, the jury returned a verdict of guilty against the prisoner who was thereupon sentenced to one year's imprisonment with hard labour.
