His Worship and he granted the re-hearing, Mr. Hastings said that Mr. Bailey and him. self were in the same matter and he proposed that both cases be taken together.
Mr. Hastings said that his client was a resident of Shanghai, and the phine came out to be transhipped to Shanghai. The documents were with the Bank in Shanghai, He understood that this was the usual course, The man in Shanghai paid the bill of exchange; took the documents, and sent them to Hong kong for the goods to be taken delivery of and transhipped. The reason why the application was not made before was that the agent in Hongkong did not know of the seizure. He intended to submit certain points to show why the sections did not apply here. The first was that sections 32 nd 39 releired to opium only and not to compounds of opiums, Mr. Hastings then referred to a judgment given in a case some days'aga, frain which he submitted that his Worship, had altogether understand that his argument ag not that the Ordinance to of 1913 tid not refer เป compounds of opium, but that the sections mentioned did not refer to compounds. From the Bank he received as salary 5623 a month and was paid commis sio as well. It was correct that his liabilities amounted to $593.057. About $60,000 of that was money borrowed by him, but as for the rest he stood security jointly with others. Out of the $193.com, odd he only received $60,000. He did not remember when he first commenced boirawing money, but he did so from time to time. From the Ya Fat Bank he borrowed abaut $10,000 for his own use, and the bal-way from her? ance was guarantee. The Wong Fuk firm borrowed the money and he and others stood curty.
