of such act, and also upon the discretion of the authorities responsible for controlling such matters, who, judging from sho matter affected in their interests were endingered or injured by certain cts. In the present case, the wite ness Shimizu Kaichi, who holds the post of Bikugun riji (judge advocate for the Army) testifies that (A) the matters under considera. tion are treated as military secrets, and that the mobilization of the-division referred to in statement No. 1, when this fact was commu- nicated abroad, was the division remaining at home and its employment in active warfare had considerable significance on the then situ atian-not a light matter fra military point of view (6) Disclosing it was greatly to en- danger lapan's military plans. The date of the landing of the division, and its subsequent dis posal, as revealed, was openly the violation of a military secret. C.) The Division mea- tioned in Statements Nos. 2 and 3 and the Division proceeding northward-th having reference in the military movements after the capitulation of Port Arthur-and the date of their arrival and the name of the place. All there were disch sed before the battle of Mukden. The matter had in:lescribable beat.

ing on the military plans then contemplated and no doubt endangered Japan's military position. (D) The Statement No. & indicated the condition of forces. They do not nères- sarily form the exclusive composition of the Port Arthur Investing Army alone; the secret must be kept as long as military plans possi. ble. (E) The statements Nos 5 and 6 deal with composition of forces, the date of their departure, their destination and the method of transportation, every belligerent must try to keep secret the movements of such forces. Its disclosure is bound to injure Japan. All the statements considered this far come under the purview of military secrets.

The accused in his defence contends that a- portion, at least, of the secrets are no longer secret, since they were written in newspapers, known to the püble, and by the time his dis patches reached Paris, they were obsolete. It must be noted that occasionally a feature ar features constituting a military secret come to bo.known in a casual way by the public, or sometimes through inadvertent writings in newspapers. But as a rule they do not 'dis- close the whole organizvion, or its constra: live elements. This being the case, it by no means follows that the matter loses its character of a secret. As to the contention that when the information got Paris, the secret was lost, it is apparent that beyond the more or les mitigation of injury resultant spun publica. tion the matter remains the same. Whether a military secret was detected or act must be ascertained at the time of such detection, like wise what constitutes a military secret. The accused's plan, that it must be determined by result, falls to the ground..

(3) As regards the question whether the accused dete led the military secrets himself,

accused maintains that he learned them from other people, or;aw-then limsel, or learned them through newspapers and Maki Ko, there- upon drawing his deductions and arriving at data. He forwarded his intelligence as such, baing merely guess-work, and not detected. But (1) Exhibit No. 851 (copy 3) page 67, con- tains a statement addressed in General Hore- aux, that it is very difficult, more difficult than can be imagined, to collect correct information, and that I am one of those who are able to detect secrets well," etc. ) Exhibit 861 (copy No. 7), from pages No, onward, contains letters addressed to De Lubry saying that the accused experienced great difficulty in detect- ing a certain stem. (3) Maki Ko's evidence in Court shows that ostensibly he was sent to Napaya on a commercial etratid, hut was ordered to repon on military matters as they came to his nuties. This shows that the accused detected secerts. (1) The accused himself admit that he learnet from the others.

also that he collected information from news. papers and sow himself, drawing his deduction therefrom Lia also collected facts pertaining

to military matters, thereby constructing a comprehensive analysis. This process may be put down as a certain means of finding out military sectais, All this evidence and the ac- cused's own statement show that he was en- gaged in detecting military secrets.
