With reference to paragraph 5 defendant denied that the matshed referred to was erected subis sequent to the granting of the Crown Lense and stated that it was erected and in use at the time the lease was granted. Defendant admit- ted the erection, in the month of July, 1901, of a matshed in substitution for the original mat shed which was destroyed by a typhoon in July, 1902, as alleged in paragraph 9, and also admit ;ted the use of the matshed as therein alleged. In further answer to the allegations contained in paragraph 7 of the claim the defendant de- nied that either the original or substituted maishd mentioned prevented or prevents the access of vessels to the new wharf; denied that either of such matsheds was or is in any degree obstructive to plaintiffs' use of such wharf, and denied that either of such matsheds andangered or endangers their property or was, or la, in any way injurious to them. The defendant denied that there had been any breach by the Govern- ment of the Crown Lease, dated ist October, 1901. and stated that the searching of passengers complained of by the plaintiffs was authorised by Inw and was in accordance with the provi- sions of section 19 of an Ordinance of the Legislative Council of this Colony, entitled "The Prepared Opium Ordinance, 189," For a further defence to the plaintiffs' claim the defendant stated that the same was bad in law, on the ground that the acts, facts, matters and things therein alleged did not disclose any cause of action on the part of the plaintiffs against the defendant
The Attorney General argued the case at length, and shortly before tiffin the Court was adjourned till 10.30 nm. an Wednesday, when Mr. Sharp will address his Lordship.
