ALLEGED ASSAULT ON A- FOREIGN LADY.
ACCUSED'S VERSION OF THE INCIDENTS
Hanada Toichiro, the Japanese who is alleged to have assaulted a foreign, Indy in Ikutamaye, has appeared before the Kobe Ku Saibansho. The man was ordered into detention for three days by the police, against which sentence he now appealed. Mr. Yoshizumi, barrister, appeared on behalf of the defendant."
In reply to the Judge, accused said he regarded the penalty imposed on him by the police as- unjust.
The Procurator, Mr. Furnichi,, addressing the Court, said that at about 9.30 one morning recently, Mrs. H. Irving Bell residing at No. 8 Kitano-machi, 2-chome,
Kobe, accompanied by her young són,
called at the shop of accused with the object of making a purchase. The lady did not buy anything and was leaving the shop when accused fallowed her with the broken lid of an earthen ware jar in his hand. The man alleged that Mr. Bell's child had broken it and asked for compensation, at the same time taking hold of her hand and preventing further progress, in this way committing the assault./
The Procurator having finished his statement, the Judge asked accused if he had behaved as alleged. Banada, in reply, gave his account of the incident, saying that on the m roing in question the lady visited his shop'accompanied by a child if about five years of age. She had inquire the price of a Bizen teapot, but declined to pay the sum asked. At this time the boy broke the lid of n jar with his foot as he was attempting to reach something from above, and the wife of accused, who was attending on the lady, asked for compensation for the breakage, but this was refused. The woman complained to accused, who was working at the back of the house, and accused at once went to the lady, showed her the broken lid and asked for compensa
Mrs. Bell struck eccused on the tion. head with her fist, and the blow was so hard that his cap was knocked ten or twelve feet away. She also kicked him, and after wards put her child in the urina and began to walk away, Accused was about to return to his shop when some of those who had gathered round urged him to follow and obtain the ad- dress of the lady, as she had acted unlawfully. He took this advice and walked as far as the
Sankaku choba, a little up the Ikuta Temple avenue. Here Mrs. Bell's private Jinrikisha with two of her children met them. The lady seated herself in the Euruma, and. taking a bamboo stick which one of her children car ried, struck the accused on the head, causing blood to flow. Accused made no resistance, but followed the lady. He complained to the policeman at the polivu box in Kitano-machi, and with the policeman went to the lady's house, but could not get in as the gate was closed. As his head was bleeding he went at once to Dr. Yoshikawa in Kano cho. Accused denied having acted insultingly towards Mrs. Bell,
In reply to the Judge, Haneda said the lady understood Japancic very well. He had never taken hold of her arm, but had only defended himself,
Mr. Yoshizumi, counsel for the accused, said that at first sight the case might appear to be ́s very trivial one, but on examination it would be found to be very serious. He urged that the Court should thoroughly investigate it. The facts of the case were quite contrary to what was stated by the Procurator On the news of the incident appearing in the Kobe Chronicle of the 31st ult., the Kobe police immediately summoned the accused and punished bim for
a misdemeanour, without inquiring into the
merits of the case..
Hanada was asked when he was sentenced to the detention, and replied that it was about noon on the 31st ult. Shortly after to mm. on that day, he was summoned to the Police Station, and on arrival there be was examined and immediately sentenced.
Mr. Yoshizumi said the most remarkable phase of the case was the action of the police in favouring the foreigners to such an extent. The policeman who drew up the statement for the prosecution was not present and did not witness the incident. He went to the assist. ance of the accused on his application. Im mediately on seeing the report in the Chronicle, the Superintendent of the Koba Police sum- moned the policeman in question, Komori by name, and ordered him to take steps for the prosecution of the accused. The police. man said that the report in the Chronicle was entirely different from the facts of the case, and added that if the man was prosecuted serious consequences might follow. The policeman suggested that it would be better not to prosecute him, but the inspector in charge of the case ordered Komori to take the
