CAPTAIN ARTHUR CLARKE, who re- cently commanded the Undaunted, on the China Station, has been mentioned as the successor of Captain Montgomeric in command of the Prince George.
THE MINISTER TO SIAM:-The appoint ment of Mr. Reginald Thomas Tower to be His Majesty's Envay Extraordinary and Minis- | ter Plenipotentiary to his Majesty the King of Slam, and also to be His Majesty's Consul General in Siam, appears in the Gaserie of the 5th inst.
WU TING-FANG, the Chinese Mipister it Washington, says that he has received na notice of recall. He would not, however, be surprised if his Government contemplated recalling him, as he has served over the customary time which is allowed a Minister at one place).
WAR EXPENSES-Hints at increased pay-- ments by the British public for war expensua were thrown gut by Sir Michaei Hic s-Beach at a convivial gathering in his own con- agency. The war, he said, dragged on, and it might be that when next year came he would have to ask the people of this country to bear even greater burdens and to make even greater
sacrifices.
CITY HALL TO-NIGHT.
There should be a full house to-night to witness the various boxing events that are The Sanford v advertised to take place. Warren contest should be of interest, and if Howell is going to make it willing with Howard it should be well worth witnessing as Howard is very smart on his feet. Hendrick is undertaking to stop "Sailor Smith" in six rounds, and if this is going to be a straight go, and we repeat if, we are under the impression that Headrick lus taken on a pretty tough There is one thing that helps to make belief that the contests will be on, the square, and that is the names of the people responsible for the proper conduct of the pin- ceedings. No better referee could be found than Mike Collins, and the same applies to Mr. Froit of the "Empress of Japan" as time keeper. At the same time we hope these officials will keep a sharp look out as there will be "a chiel amang ye takking notes".

PIRACY STILL FLOURISHING,
DESPERATE DAND ON WEST RIVER. Surprising as it must undoubtedly be to those at home that piracy should flourish in British waters within a few miles of a most important Colony it is neverthelesss an inconvertible fact that in these enlightened times, and after sixty years of British influence, that piratical attacks
not only flourish but are apparently on the increase despite the steps which are taken for their prevention.
Within the past few months we have recorded on junks and several very daring attacks steamers, not the least. noteworthy being the Cap-sui-mun horror, which so far as regard. ed the actual loss of life nearly equalled the Namon tragedy of December, 1890.
Latest advices bring to hand an account. of the proceedings of a desperate band of pirates on the West River. On Friday afternoon last, at a place known as Kumchuk, situated sume thirty miles to the South of Samshui, a gang of seafaring roughs watched their opportunity and when the skipper and crew were ashore took -possession of a steam launch and crossed in ber to a large fishing village and held it up, They terrorised the rative population and of Everything they obtained possession could lay hands upon, Afterwards they on board of got their stolen property the launch und, re-crossing the river, beached her and cleared off with the valuables
Yesterday afternoon the pirates seized the Kwang Kun, which is the fastest launch that plies on the West River, and during the even ing she was seen up a side-creek leading through the delta to Canton. From some source or another they received information that a launch was steaming from Canton with a party of wealthy Chinamen on board, and in the hope of securing valuable loot they decided to waylay her and take possession. Whether the piracy actually occurred, had not transpired at the time of going to press, and further parti culars are anxiously awaited.
It seems a great pity that such attacks can. not be prevented, especially considering that British gunboats|patrol the river in the interests of trade, and it is evident that an enquiry into the numerical strength of these craft would not be out of place.

The Han. H. E. Pollock; K. C. (Acting Attorney General) and Mr. H. W. Slade, barrister-at-law (instructed by Mr. J. Hastings). appeared for the plaintiff, and Mr. E. H. Sharp, barrister-at-law tinstructed by Mr. J. S. Harston) represented the defendants.
The following jury was sworn-Mesars. V. A. Hawkins, J. G. Smith, J.-N. Goosemann, R. Marin, A. G. Stokes, W. M. Watson, and J. W. Bowles."
at
It appeared from the statements of Counsel' in the formed action Mr. Luk Lai that Cho sued. Mr. T. II. Kingsley, who was the time in Shanghai, for the specific per- formance of an agreement, bearing date the 18th October, for the sale by the defendant to the plaintiff of a certain piece of land situated at Kowloon, and registered in the Land Office as Marine Lot, No. 39. The plantiff lost that suit, and how sought to recover the sum of 544,325 from Messrs. Kinghorn and Mac. Donald, the agents in the disputed trans- action. The plaintiff contends that the property was actually sold to him by the defendants, and Mr. T. H. Kingsley repudiated their action. He was to pay $325,000 for the land upon the understanding that to per cent should be paid cash down, and the balance within a period of Mr. Kingsley repudiated the six months. authority of Messrs. Kinghorn, and MacDonald to bind him by the acceptance of the offer, and maintained that he had only authorised the defendants to accept an offer of $325,000
cash down.
The amount of damages now claimed represents the diference between a sum of $325,000 for which the plaintiff had agreed to purchase the property, and the sum of $369,325 representing 197,500 square feet of land at $1.87 per square foot at which rate the plaintiff, by contract, had agreed to re-sell the land to the Hongkong hand. Investment and Agency Company Limited. The plaintiff also sought to recover the amount of costs incurred in the previous action. On the other hand the defendants allege they were acting as special agents to Mr. Kingsley at the date of the completion of the sale, and were under the mistaken impression that the vendor would confirm their action. The sale took place on the 20th October, and as soon after as possible the defendants told plaintiff of the mistake, and of the refusal of their principal to confirm the sale. They denied. the alleged breach of warranty,
Evidence in support of the contentions was then commenced the first witness called being Mfr. John N. Kinghorn, the senior partner is
the defendant firm.
The case was still proceeding when the Court rose for the day.

Miss Emmie Smith's coon songs will long be remembered, and we must not forget our own particular ballet that has helped to fill the front seats night after night. We hope to see the members on a return visit as they have pleased their audiences from the stage and earned the re- spect, by their conduct, of all they have met.
