Mrs. Prances D. Carroll, citizen of Ken- tucky, U.S.A., who has been resident in Japan for nearly twelve years, has lodged a complaint at the Procumlor's, office in the Yokohama District Court, charging a hoy named Wake hara Harukichi, employed in the restaurant above the Yokohama Station, and a policeman", named Ishikawa Kumakichi, attached to the Iserakicho Police Station, with an aggravated assault upon

ber.. The complainant states in her charge that on the evening of the and August last, she arrived at the Yokohama Station about 8.40, on her return from Miyanoshita. Feeling very poorly the ordered some iced lemonade and after some trouble noticed that the boy who had served her, and another boy, were apparently making some kind of rude remark about her. She put the large glass down and told them to go away into the back portion of the restaurant, and motioned to them also with her hands to do so. Instead of going away the pair wheeled right forward and stood in front of complaint's table and became so insolent in their bearing that the complainant rose from the table, left the room, and went downstairs in the station. At this juncture the bay, Wakahara Harnkichi, came

after complainant downstairs and caught her by the skirt of the dress from behind, asking her to pay. Comptaniant answered that she had not taken any lemonade because the people upstairs were an kude that she could not

stay to drink it, and as she did not drink any, she would not pay. The boy then said he would, call the police, and complainant replied: "All right! Call the police!" The boy then called * policeman (Ishida Kumakichi) who came up instantly. The complainant then began to ex- plain the difficulty, but as the policeman did not understand English, and her Japanese was so poor, she asked him to go upstairs in order that she might show him the lemonade on the table. The three then went up into the restaurant when the complainant pointed to the table-where the glass of lemonade stood, telling the policeman that she had not taken any, and saying that the

boys were so rude that she went away without either drinking or paying. The complainant then turned to go downstairs, but as she got three or four steps down, both boys seized hold

of her, one by her left wrist and the other by her right hand and right wrist. In order to resist, complainant sat down on the stairway and pulled against her assailante, pinching the hand of one between the thumb and fore: finger, and making a faint to bite the other. The boys then let go of complainant, and the instant her hands were free she caught the supports of the banisters with her left hand three or four steps down. The buy, Wakahara Harukichi, then seized complainant's right 'wrist and the other boy came to his assistance, trying to pull complainant back upstairs. They pulled so violently that they torn her sleeve. All the time they were pulling to get her upstairs, the was pulling back against them, and she suddenly jerked her arm and pulled the two boys over, with the result that they fell, tumbling down stairs. The complainant then got down two or three more steps, when the boy Wakahara got up and came after her and clutched her wrist with both hands. At this time the complain- ant began to feel almost unconscious from pain and fright. The boy Wakahara, kept asking hor what was her business, and she replied that that was nothing to him. This was repeated three or four times. Then the boy tried hard to twist round the complainan's arm,. and she states that his teeth were clenched and that he looked a "perfect imp from Hades 1". She thought that he was trying to break her arm, as neither the policeman standing above

on the stairway, nor the byslanders below, showed any disposition to interfere or assist abe called out to the people below: Nikai no no ho ga, abunai! Dorobo ga arimasu!" Then

Wakahara struck the complainant on the shoulder, and chest several times with great violence.

At this juncture, two men in the station uni- form rushed up the few remaining steps, and said something to the boy, and at the same moment someone or more in the crowd below

called out something, on which the policeman Tabida immediately ran down the stairs and sore the boy off complainant. All parties then went downstairs and when they reached the station the boy again seized hold of complainant, and the policeman looked on
