In this case the plaintifs claim $44,318.34 for loss upon cargo insureil by the defendants and shipped by the plaints from Tientsin to Amoy upon the steninship Actie, which vessel was totally lost on or about the gth lay of Nov, 1898, The plaintiffs further claim their costs of suit.

Mr. W. V, Drummond and Mr. E. Robinson (instructed by Messrs. Dennys and Bowley) appeared for the plaintifs and Mr. J.J. Francis, QC, and the Hon. II. E. Pollock (instructed by Messrs. Johnson, Stokes and Master) for

the defendants.

The following composed the special jury Messrs. G. Moxon (foremin), CV. Dixon, E. W. Mitchell, A. labington, C. C. Inchbald, T. 1. Rose and G. P. Lammert.

The whole of yesterday afternoon was taken up by the opening of the case by Mr. Drum- mund, the greater part of which we reported last night.

After speaking, at length, on the law bearing on the case, he concisely and clearly put the facts before the jury for their consideration. They are briefly these:

On the 12th October 1998, the steamer five was chartered on behalf of the plaintiffs to carry certain goods for them from Tientsin. The steamer reached Tesisin on the 27th October, and left loaded on the 31st October. On the 9th November she became a tout wreck of Tamsui. Six days before she left Tientsin an insurance of $10,000, was effected, and a father insurance of $4,318 was subsequently taken out. The plaintiffs endeavoured to get payment, but were not successful. Mr. Drain- mond Ginished his opening at about half-past three, when the Couit adjourned,

SEVERAL DEATHS FROM THE COLD AND EXPOSURE,

A resident of Shanghai writes under date of Gli instant:"Christmas Day was wet and bitterly cold, while New Year's Eve was intensely cold and snow, driven by biting northerly blasts, fell to a depth of about three inches, so that New Year's inotn was distinctly seasonable, reminding one of many a happy New Year's day in the home-land. During the day a thaw set in.and made the town very sloppy.

Several Chinese succumbed to the cold and exposure on New Year's Eve, and so com- menced their New Year in, let us hope, a happier sphere.

To-day (6th) awoke to find the ground again covered with snow several inches deep, while the northerly wind howls though the town and makes the wish he were a gentle man at large and therefore nor obliged to maffle up and trudge to office and inkslinging.
