COLLEGE

At the meeting of the Sanitary Board this afternoon, an application was submitted by Mr. W. Danby, on behalf of St. Joseph's College, for permission to erect two water closets at St. Joseph's College. In the application Mr. Danby stated that these closets would only be used by 12 Brothers, 80 students and boarders, and in valids who were sent to the College for the purpose of recuperation. A storage tank con- taining 400 gallons was proposed as to be erect ed for the special purpose of providing water for those closets. Appended to the papers were the following minutes:-

That was not the course taken in the case of in re Chester Exparte Chester Law Reports 22 Queen' Bench Division p. 632. Without desiring to lay down any general rule, covering cases where such a flaws discovered for the first time after the order for adjudication, I decline in this case and on this application to go into the question of whether the Receiving order was duly made by. Sir John Carrington. That feamed Judge was in the Colony for more than six months after that order was made and could have been applied to while all the circums tances were in his knowledge-I cannot satis factorily know exectly what facts he had before him when he made that order. Accordingly | refuse the present application. The costs of the solicitor for the creditors and official trustee will be allowed out of the estate.
