Mr. Melbourne, cetineing, said that he contended that Randall did not see anything at all. He was shortsighted and imagined that he saw everything. Counsel asked that his evidence should be discredited, If Woods did tell Randall to take command of the vessel, also

guilty of mutiny. The prosecution alleged that Captain Toulmin fired the shot at the comp dore. Counsel contended that Captain Toulmin had no revolver at all. "Had he had a revolver and wished to protect himself after the shoot- ing, he would have brought it on deck and not taken the Winchester rifle. He contended that the compradore hadshot himself by accident and if they found that Captain Toulmin had shot the compradore, he submitted that they must sequit him owing to the mutinous conduct of the crew. The prosecution had not proved malico and wilful murder and had not proved that it happened at Wuchow. In conclusion counsel said "Gentlemen, I leave it with you and I ask you to nequit Captain Toulmin an the charge on which he is brought before you to-day,"

The Court ordered it the log book, portage hook, and articles should be produced and made exhibits for the consideration of the Court in connection with this case.

THE HONGKONG TELEGRAPH, TUESDAY, DECEMBER 13, 1898.

The Singapore Marine Department has obtained a summons against Captain Hunter, of the S. S. Fantee, for carrying dynamite as

hat he would have to took after his witnesses's facs and no objection was made to it The only question was whether they would bring Mr. Randell from Manila, or not; with the go with sixty-four passengers on board, the number under such circumstances being limited agreement of the Counsel his deposition could to fifly. The case was postponed for a week, be taken there. Mr. Williams, tells me that owing to the absence of the defeudant. subsequently to the time he notified. Mr.A Singapore Chinaman recently reported that Brutton as to the winesses' fees, and Mr. $30, while walking in Nankin-st. It was he was robbed of a diamond ring," "valued at

Brutton told him if he must do it, it should be snatched from his hand, but he caught the man who took it. Five other men then attacked done,

him and forced him to let go. Two men have been arrested on being pointed out by the prosecutor. Another version of the story, how ever, is that the prosecutur had been to a wedd ing in the street, and was hardly in a fit state to know whether he had a ring of nôt.

Mr. Williams-That is the fact, Mr. Brutton. Mr. Goodnow There has been no objection on the part of the prosecution to this batil Friday or Saturday and I myself spoke to Mr. Brutton on Saturday at noon on the matter. it has been the practice in the United States Courts in China, that where a complainant or prosecutor was represented by a reputable firm of attorneys, that we have not required them to pay up in cash the costs before the proceed. ings began. There has never been a case to my knowledge before thiswhere such attorney, after the trial had begun and after having had due notice long before that he was expected to do this, had refused to pay. It is the order of the Court that the ecmplainant shall pay the costs of this trial unless the defendant, has sufficient money to pay his witnesses' fees and it is the order ofthe Court that unless the Counsel for the Mr. Brution then summed up. He said that prosecutor shall pay into this Court or satisfy an objection had been mised by his friend with this Court that the fees of the witnesses for the regard to the place where the shooting occurred. prosecution were paid, that a copy of this The information was filed by Chen Kainarder shall be sent to the British Consul and Chuen, brother of deceased

At this stage the log book was brought inte Court and on Captain Toulmin extunining it' declared it to be in the same condition as when he left it on the Doring with the excep tion of a sheet of foolscap which was missing and which contained an account of the trouble with the boy in the morning, together with the incidents üll 5.30 p.m. of that day,

Mr. GoodnowThat is you client, is be? Mr. Broton-That is my client. Continuing, Mr. Bruun said that it was un. necessary in a charge of murder to state where the crinie occurred. There were four defences set up in defence of this trial, that of accident, the allegation that the compradore was shot by somebody in the scuttle hatch, justification owing to mutinuus conduct and place of the murder. Could they believe that all these

that his friend should have confined himself to things could have happened? He submitted one of these and attempted to prove it but he could not and should not put before them these defences and say that they might have hap pened. This was a question of credibility be- tween the witnesses of the prosecution and the

It is reported from Jelutong that, during a gale the other night, a cocoantit tree fell upon house in that village and demolished it. The two men who were occupying it at the time were amused, as the correspondent is pleased to express himself, and there is really no reason to suspect the truth of his statement. The tree fell across the body of one of the men and pin ned him to the floor, but his companion was untouched, and promptly shouted for the police. With the help of several neighbours who rush- ed to his assistance, he succeeded in liberating the prisoner. the

accused. The most serious insinuation of his learned friend was that the prosecution bad combined to bring a charge of murder, the most serious charge that could be brought--Mr. Goodnow-No-argument is possible to get him convicted of murder. This was absolutely ridiculous. It was the best tési öf credibility or otherwise of witnesses as to their appearance and the mode in which they gave evidence and whether they were speaking the truth or not. Counsel then traversed the facts of the case as set forth in the evidence.

the matter. The Court will hear no further argument în the matter.

Mr. Goodnow interpreted the law regulating. such crimes. He said that the fact of two nationalities being concerned in a cuse like this had been the subject of great thought on the part of those making treaties and in the treaty between the United States and China it was provided that subjects of China who committed crime should be arrested and punished by the Chinese authorities according to the law of China, and any citizen of the United States who committed a crime should be tried and punished by the Consul according to the law of the United States. He then quoted passage from the treaty to this effect, In order to safe- guard that justice equitably and impartially it was laid down in the United States code that the Consul should give the decision in the case and that other minds and other fadments might be brought to co-operate with him and it was

provided that in capital aises four reputable American citizens should sit with him and either agree or differ and should note in the judgment their reasons for agreeing or differing and that the Consul should render the decision. In this case his government had thought it of

nough importance and had so desired that should be thoroughly understood that justice should be done, that when, it was found that the United States Minister at Peking was unable to come down and sit in the case, the government ordered him as nest in rank in the Diplomatic Service to come here and sit with the Consul The Court had thought the matter of so much importance that a lot of its time was allowed to be taken up with things of nu importance in order that it should not miss any grain of material which might have a bearing in the case. With re- ference to the form of the indictment that the

murder was committed at Wuchow, the point was not material. If it was proved that murder gr manslaughter was committed by an Ameri ran on Chan Lei Sun, the small detail in the indictment could not cut any figure. These

Consular Courts were not presided over by trained lawyers, nor presided over by men funiliar with tie technical details with which lawyers should be familiar, and accordingly that equity should be got without technicalities, They had seen here that when the Court was not satisfied, the Court had asked questions Impartially. The point as to the shape of the Indictment could not, therefore, be held. He read section 534 of the United States Code and said that, in other words, there were two crimes: killing came under two heads, murder and manslaughter, The essential difference was that murder was unlawfully wilfully and aliciously killing a person and manslaughter was unlawfully and wilfully but without malice: The only point in that definition was the defini tion of malico as used in the law. Malice was settled hatred in one man to another but malice In law was simply without sufficient provoca.. jon and did not presume for one moment pre.

Mr. Brutton-Then I shall have to take funlier steps in the matter. If you honour declines to hear me some one else will,"

The Court then adjourned to be convened on notice for the delivery of judgment.

A rather smart variation of the confidence trick was played on a Malay employed by Mr. Prakke, at Singapore recently. He was sent to the bank with Sao in notes to change. On his way back with the money in a bag he noticed a Chinaman walking in front of him and two others at his side. The former drop. ped something which his confederates said was a note for $100, which, of course, they were willing to divide with the Malay, who accoin. panied them to a house in Robinson-rand to talk over the matter. They decided to go on to the Bank and change the note, but on the way they met the Chinaman who had originally dropped the "note" He claimed his property with some warmth, but the others thrust it into
