It was in con- sequat ce of #raco'i g between Mr. Brojimly and Mr. Gorham on gh April that I went to Mr. Gotham on the next day. I asked him what be meant br. bloging thin caso #galost us. He raid he did not wish to discuss the malter' and wanted to mike business proposal, I said "Gorham, I do not understand what you mean" He said "Ob, you are a basi mess man. You ought to understand it." I wald "I do not." He said "Benjamin will, You go and consult him. You have all Sunday to think it out and coms back to me on Monday morning. I am not here for my health. I said "Look me in the face like a man and say it to me agalo," but he would not. He said " Kelly kas A large house and he can afford to pay." He informed me that since the case was brought several people bad gone to him and said that they would pay his expenses if he lost the case. They wanted to smash us. I said " I can let you get anybody to axblicate the ex10 * and ke said "No, my friend," I personally had no authority to buy and sell shares for Mr. Pailishwalla batt Mr. Kelly had sud during his abionco this wan done by Mr. Bosjamin.

Cross-examfand by Mr. Francis, witness said he did not know when Mr. Kelly bad that autherly but when witness joined the arm Me. Kelly had that anthority. Whas witness jɔlned the firm new rets of banka - wes used. He thought be left Rossel and Co la 1890. He did mit leave Ruerch and Co. recause of the saft with Mr. Rustomjee about Rope shares in which case he was the plaint ff. He remembered that the defence in that case was something like a fculous combluation to raise Rope shares.

Mr. Francis read the finding of the Jury as follows-We hold that for some time after this day there was a combination to raise up to Actitions prices the value of Rope shares of which the plaintiff was a partner,"

Winess said he did not remember it but as it was in print it must be correct. He recollected that he said that he and Mr. Shewan did not apply to Mr. Whichead for an advance or loan of shares and Mr. Whitehead wore directly the contrary. He remembered that the Judge in summing up ved the jury to accept Mr. Whitehead's version rather than bls. He remembered being flatly contradicted in what he sald by Mr. Tomes, are of his amplayers. It was not a fact that witness left Russel & Co. in con- sequence of this case. Mr. Pollistalle made no profitin baying and selling the Indo Chins shares on 6th November. The brokerage witness's firm had by the transactions was $ito.

Mr. Franels: Is Pailishwells here exclusively. Jor the benefit of his health?
