Kelly, and G. H. Putts, abazebrokers carrying on business in partnership In Hongkong. The plaintiff claims (1) that an account may be taken of all raics and purchases of shared by the defendants for the plaintiff as bis brokers, and of all monies received and paid by the defendants for or an account of the plaintiff from the rat Apell, 1896, to 15th March, 1897, and (1) that the defendants may be ordered to pay to the plaintiff such amounts, if any, as upon the taking of such account shall be found to be due from the defendants to the plaintiffsace. with interest on the several amounts from the dates when the same became respectively due and payable.

To Mr. Drummond: I remember talking with Mr. Benjamin at the Tramway Station about tha 9th April. He requcated me not to take the matter any further and he would pay me the costs. He spoke about the Indo-Class and West Points and salḍ that Mr. Potts had told film that he had stranged double brokerage I told him that it was not so. Ha sald that Mr. Polts said that it was so and they should not go into Court for $15. I said that I would go into Court to fad it out il necessary. I purchased the Indo-China shares at $40%. This was the fall price. I purchased them from Messrs. Benja min, Kelly and Polis. I took delivery of thera
