to respect to the evidence for the defence word or were not taken by gurpiles and, second, whether or not the f«rue which bis žien d by his evidence thought fit to raise was sa itsua which was on his or not. The fsci willl re- maized sit the stronger on his ownsivement that he deilberately omitted and that he would have prejudiced his cave if he had pleaded that there were negotiatioan with reference to a periton of the land or pleaded anything with exference to the meeting of 15th March, The plsinuff alleged a declarailón "of treat as to 1381 and put in all the evidence in the cor- respondence with reference to that; and that was complets. No person reading the conespon dence would have a shadow of doubt that the "alte" referred to wai 1381. The correspondence adduced was a complete and perfect ciis. His friend set up a affirmative lane. He asserted. us voon at ika circumstances appeared, that not the whole of 1381 was meant but only a part of it. Evidence should be taken from both sides as to what the circumstances were. He submited that his fearned friend should not be allowed to Into the argument at this moment, first, hê- cause it was irrelevant, and secondly because the proper time for him to have argued It was at the moment when the plaintiffs' care was closed. had potated out, chose to put lo a string of cor Mr. Pollock sald that his learned friend, as he
respondence and he chose to do so without any evidence of the facts of the care or the surround- ing circumstances. Counsel's costeilen was that he was enti∙led to give evidence to enable the Court to judge what was the preclieposition of the parties with reference to the land and also what the Intention of the parties was His learned Irland had just argued that counsel should, directly the plaintiff closed his case, bave at once argued before his Lordship the polut that there was no declaration of trust and that therefore this sult should be 'dismissed on that ground; but Counsel conceived that was tot the proper course for him to do. It would have been absurd for him to argue that point only on the decumenis. Ha submitted that the only consistent course which ha could have taken way to welt gell the evidence. Bad reached a suitable strga. His barned flood was himself to blame when he deliberately omitted to call evidence to show the circumstances of the cLIC. The case of Pann v. Jack, Law Reports, 2 Equity, which was quoted by his learned filend, was endrely in the defendant's favant.
Mr. Pollock was ugulog gezerally on the meilts of the case whɛo his Lordship asked hims to confina bimself to Mr. Francia' objecṭion, that li was not the proper time to argue that the pixintiffs had misconceived their action.
After fortbar argument his Lordship said that he did not think that it was the proper time to argue that the plaintiffs had misconceived their actioo. He thought that Mr. Follock was entitled to show that his pleading was tight, and not muka reference to the defendant's dealings in the transaction. The plaintiffs' application wis that the defendiat did not set out the defence in the pleading but left them without notice and therefors they were entitled to call evidence in rebuttal,
Mr.. Francis said that if an omission was mada righily, or wrongly, he entitled to claim |that he had been liken by surprise. Ho bed no conception that b's friend was going to discuss a portion of the site, and he had spent days upon days in lying to find out the disputa bis kiend would rafss on the questku of trust. He had no idea that the word" "slie" in the decument did not refer to the whole bat only a part of 1381. His Instructions of the surround- ing circumstances differed from those of his learned friend and his information of what transpired at the meeting of 15th March was totally different in point of fact from that of Mr. Pollock. Therefore he was surprised and did et know what versienet the meeting wis going to be given.
His Excellency thin thanked Mr. Liao-Tags Shan and Mr. Fung Wa-chao for their kind remarks We stated that he felt sure his wishes regarding the Tang Wa Horpital would be duly and properly caled out, During the 6 years. he had been Governor of Hongkong he had always rece`wed the loyal support of the res- pectable and wealthy Chinese of this Colony. His Excellency thes concluded by requesting those present to drink a glass of wine and pro- posed an a forat "Success to the Tung Wa❘ Posplal and prospertly to the Chinese Come
unity." The toast was drunk with enthusiasm.net
ANOTHER FATAL COLLAPSE.
His Lordship gave his opinion that if the defendant bad set up a differant case from the evidence would be received but on the other pleadings the application to call rebutting hand if that had not been done the plaintiffs should have come prepared. But it was not clearly shown in the pleadings. The omission in the pleadings was an important matter mud had an important besting with sefere ce to the recallag of evidence in rebuttal. He thought Mr. Pollock was entitled to show to the Court that according to the rules the pleadings wera - correct. If he could do so it would arisabledly help his case.
