HONGKONG AND HANGHAI DANK VARSUS
FBRA PAKDES.
In a comparatively recent fasue we published panicolars of the sulbbrought by the Hongkong and Shanghat Banking Corporation in the Inter- national Court at Bangkok to recover Ticals 131,145-75" from oño Phra Paldes, & Starlete oplum farmer. Tho hezilog was concluded on the 26th ultimo; Counsel addressed the Court on the myth, and judgment was reserved till the 18th, when it was given in favour of the Bank.
Mr. Tilleka summed up on behalf of the plaintiff Bank and he was followed by Luan Suntborn Koss, in Siamese, for the defence. The speeches are too length for publication in these columns in exients and we therefore give excepty from them, as published in the Observer, as follow:-
FOR THE PLAINTIFY,
Mr. Tilleke concluded his address thas-The Bank has only one temedy, and that against the known principal, Phra Pakdee. We have nothing to do with Mr. Maclean; we only accepted him as agent of Phra Pakdee and we look to Phrs Pakdee for the money. It Phra Pakdee, say Mr. Maclean misappropriated his money Mr. Maclean can be aned in the British Court. Phra Pakdee need not be afraid of the British Court. Britlah justice is well known all over the country and Phra Pakdee will have fall' and speedy justice if Mr. Maclean has misappropsisfèd kis money. The case in a very simple one really, but has been involved by the action of the de- fendant. I do not think for a moment that the Court will consider these accounts as concocted, Therefore the only conclusion to arrive at is, Have thers moneys been paid out from time to time to Phra Pakden or his Agent? That they have been paid to Phra Pakdee and Mr. Maclean as his agent is clear from the receipts. We have produced vouchers for every single llem here. If the Court is satisfied that Phra Pakdee knew there was one overdraft only, there will be no difficulty In deciding that be must pay this money. Now, Phra Pakdee admits that he went to the Bank and Mr. Hunter write out the slip I have put in showing the smount of his over. draft. Now, Mr. Hunter also says that he did write out a memo., but I must point out that that memo is not in the Cantt." Phra Pakdës has got it up to this day, because that memo." would show Phra Pakdee was indebted to the Bank in 433,04 on February 27th. Mr. Hunter has sworn that he gave that amount. The slip we have filed is not the one that Mr. Browɛe gave him on February 17th, but one that Mr. Hunter gave between March 9th and 14th after Mr. Browne had left, for that slip shows, that Phra Pakdee owed the Bank 311,802. The Court, when it comes to look at that memo,, will see that it has the figures in English characters, and nothing at all about the Singapore secount. Phra Pakdeo admits that he took that slip to the shroff, who wrote the figures in Chinese, and also added the figures of the Singapore account. Now, Phra Pabdo says he took ihla and compared it with his account and found it did not tally, and -sa-be took it to Mr. Maclean who told hima something about oplum in Singapore. That showed as large a um as 311,000 overdrawg la Bangkok, and over 100,000 in Singapore. Now il he says he always knew he had plenty of money he would have known that so large a

Winess was cross-examined at length by Hr. Slade av to the locality of the shop and its arrangements. It was brought out that two other knives besides the one produced were lying on the floor.
Cheong Kwak, the acrosatent of the shop, gave corroborative evidence, adding that after the abusive language he saw the deceased strike and then thrust his arm round the prisoner's the prisoner on his sight check with his clenched

He could only remember on two occasion-one when Phrs Pakden went to buy a draft to Hongkong, That wason Feb. 8th, 1895. The Bank hadthdrown fnerpreter and asked bira to produce that boy so as to corroborate him. He could not produce the boy. On another occasion, that was 10th April, 1895, when Dr. Yal Phranada, and Lunag Surthorn were at the Bank, you had heard the evidence of both these gentlemen and they sald the only occasion they went together to the Bank was when they sold the rice-mill, and that was on the 9th March, 1895, and they did not see Phra Pekden thers,
$ 400,000 could not be owing and would not have kept galer, but would have gone to the bottoms of it. He would not have believed Mr. Maclean if Mr. Maclean had merely told him there was optam in Singapore.. 400,000 ticals' worth of oplam would have been enough for the year. He does not go to the Bank and thrash the matter out, and why ? Because he know all about the overdraft. Then 'alter, that, after he got the slip from Mr. Hunter, he goes on paying 500,000 tical foto the Bank without drawing x cheque against it. I don't want any other evl dence or any other document; that alone shows that he knew he was indebted to the Back. I promised my friend on the other side to finish at 3 o'clock; it is already a quarter pests but I believe I bave said enough to show that | Phia Fakdes owes this money to the Bank, and that the Court has no other alternative than to order him to pay the amount.
THE DEFENCE.
The following precis of Luang Sunthorn Kona's speech, delivered in Siamese, as handed to the Observer for publication :-
The case for the plaintiffs as disclosed by the pleadings and Mr. Tilleke's opening speech was based upon the letter of the 1st April, 1893. Mr. Tilleke slated in his speech that in the course of a'number of conversations an agreement was come to, ikat Phra Pakdee should from time to time deposit in the Bank his receipts es Opium Farmer, and should these'sums not be sufficient for his requirements the Bank should allow him to berrow, apan which interest shook be charged. Mr. Tilleke went ba to. Y Mr. Browne sisted that he must have the agreement in writing-If Pra Pakden wanted to appolat Mr. Maclean an his agent, and that the defendant went away and returned with the latter of the first Apell, 1893, which Mr. Tilleks handed in. This letter was drafted by Mr. Browne him. self, copied by Mr. Franklin Hurst and signed by Para Pakdee, and has all along been the only sulholly under which Mr. Maclean acted, The latter cannot be construed to authorise Mr. Maclean to overdraw or borrow money or in any other way. It contains merely an authority to draw money actually in the Bank, either on current or any other account, Subsequently Mr. Browne stated that there

rally tight condition prevalled in the latter six. It was fortunate that the Bank, having had funds placed at its disposal by the Treasury, was able to tellave the market from serious trouble. The employment of these funds naturally swelled the volume of currency,' and during the month of December it stood at over 203,940,000 yen, kn Increment of about 40 million yen as compared with the amount circulating prior to the war. As a set-off to this, however, the expansion of business and enterprise must be taken into con sideration. Thus the volume of foreign trade #ggregated over 2894 million yen, no lucrease of over 24,140,000 yen as compared with the previous year's figures; and the outstanding Loans of the Tokio and Osaka Union Bınkı totalled 127,170,000 yen, an locrement of about 21,830,000 yen ; while the volume of exchange aggregated as much as 485,000,000 yan, an Increase of about 83,660,000 yen as compared with the previous year. Add to there the increased abscription to companies, an in- crosse in State expenditures, and so forth, and it is not unreasonable to conclude that the volume of currency is not nuwarrantably exces- sive. The rise in the market price of commiQ- diles bar attracted public attention this year. It is true thal, in the spring, probably as a result of reaction, the market slightly fell. But coming to the second half of last year, fn spite of the lighten- Ing of the money market, prices rose steadily, so that quotations at the end of the year were, in general, 30 per cent, higher as compared with prices ruling before the war. In fact, the rising tendency in the market price of commodities. naturally attendant upon the fall in the gold. price of silver, to which we must add the awaken- ing of the public mind in consequence of the victorious lasue of the war, the expansion of enterprises, the increased parchaslog power of larmers, and so forth-these matters consider ably swelled the scope of demand and tended to enhance prices. In December, 1895, the Bank. was commissioned by the Treasury to take charge of the Indemnity. In February the London Branch Office of the Specle Bank of Yokobama was ordered to underiake that busi- ness on behalf of the Bank, and the work was started shortly afterwards. The matter being one di grave moment and vitally connected with the welfare of the country, the Bank despatched Mr. Yamamoto Tatsu, Chief of the Business Department of the Nippon Ginko, is an ex- aminer leto the actual condition of financial affair in London.
